1. DEFINISI
    1. Emas adalah emas murni dengan kandungan Aurum (Au) paling rendah 99,9% yang dapat diperdagangkan pada Pasar Fisik Emas Digital.
    2. Badan Pengawas Perdagangan Berjangka Komoditi yang selanjutnya disebut Bappebti adalah lembaga pemerintah yang tugas pokoknya melakukan pembinaan, pengaturan, pengembangan, dan pengawasan Perdagangan Berjangka.
    3. Bursa Berjangka adalah badan usaha yang menyelenggarakan dan menyediakan sistem dan/atau sarana untuk kegiatan jual beli Komoditi berdasarkan Kontrak Berjangka, Kontrak Derivatif Syariah, dan/atau Kontrak Derivatif lainnya.
    4. Lembaga Kliring dan Penjaminan Berjangka yang selanjutnya disebut Lembaga Kliring Berjangka adalah badan usaha yang menyelenggarakan dan menyediakan sistem dan/atau sarana untuk pelaksanaan kliring dan penjaminan penyelesaian transaksi Perdagangan Berjangka dan Pasar Fisik.
    5. asar Fisik Emas Digital di Bursa Berjangka, yang selanjutnya disebut Pasar Fisik Emas Digital adalah pasar fisik emas teroganisir yang dilaksanakan menggunakan sarana elektronik yang difasilitasi oleh Bursa Berjangka atau sarana elektronik yang dimiliki oleh Pedagang Fisik Emas Digital untuk jual atau beli Emas yang catatan kepemilikan emasnya dilakukan secara digital (elektronis).
    6. Emas Digital adalah Emas yang catatan kepemilikan emasnya dilakukan secara digital (elektronis).
    7. Pedagang Fisik Emas Digital adalah pihak yang telah memperoleh persetujuan dari Kepala Bappebti untuk melakukan transaksi Emas baik atas nama diri sendiri, dan/atau memfasilitasi transaksi Pelanggan.
    8. Pelanggan Emas Digital adalah pihak yang menggunakan jasa Pedagang Fisik Emas Digital untuk membeli atau menjual emas yang diperdagangkan di Pasar Fisik Emas Digital.
    9. Pengelola Tempat Penyimpanan Emas adalah pihak yang telah memperoleh persetujuan dari Kepala Bappebti untuk mengelola tempat penyimpanan Emas dalam rangka melakukan penyimpanan, pemeliharaan, pengawasan dan/atau penyerahan Emas.
    10. Bukti Simpan Emas adalah dokumen yang diterbitkan oleh Pengelola Tempat Penyimpanan sebagai tanda bukti kepemilikan atas Emas yang disimpan.
    11. Virtual Account adalah nomor identifikasi pelanggan perusahaan yang dibuka oleh Bank atas permintaan perusahaan untuk selanjutnya diberikan oleh perusahaan kepada pelanggannya (perorangan maupun non perorangan) sebagai No Rekening Tujuan penerimaan (collection).
    12. SAKUMAS adalah website dan/atau aplikasi yang menyediakan jasa perdagangan Emas Digital yang dimiliki oleh PT Sehati Indonesia Sejahtera.
  2. KETENTUAN PERSYARATAN KEUANGAN
    1. Rekening Terpisah
      1. Rekening yang terpisah dari rekening operasional Pedagang Fisik Emas Digital pada Lembaga Kliring di Bank Penyimpanan yang telah mendapatkan persetujuan dari Kepala Bappebti dipergunakan untuk menampung dana Pelangggan Emas Digital.
      2. Pedagang Fisik Emas Digial wajib mengawasi dana Pelanggan Emas Digital yang tersimpan di dalam Rekening Terpisah Pedagang Fisik Emas Digital pada Lembaga Kliring.
    2. Penyetoran Dana ke Dompet Rupiah
      1. Pelanggan Emas Digital dapat melakukan Deposit Dompet Rupiah untuk melakukan transaksi Emas Digital.
      2. Deposit Dompet Rupiah dengan verifikasi instan dapat dilakukan menggunakan Virtual Account yang difasilitasi oleh Kliring Berjangka Indonesia (KBI).
      3. Setiap transaksi Deposit Dompet Rupiah dengan verifikasi instan dikenakan convenience fee sebesar Rp 15.000 / deposit. Besaran biaya convenience fee ini dapat berubah sewaktu-waktu.
      4. Pelanggan juga dapat memilih untuk melakukan Deposit Dompet Rupiah dengan verifikasi manual. Deposit Dompet Rupiah dengan verifikasi manual tidak dikenakan biaya.
      5. Dana yang disetorkan Pelanggan Emas Digital melalui Dompet Rupiah atau “Payment Aggregator” akan disimpan di dalam Rekening Terpisah Pedagang Fisik Emas Digital pada Lembaga Kliring.
      6. Dana yang tersimpan di dalam Dompet Rupiah tidak mendapatkan bunga.
    3. Penarikan Dana dari Dompet Rupiah
      1. Pelanggan Emas Digital dapat melakukan penarikan dana dari Dompet Rupiah setelah melakukan verifikasi KTP atau tanda pengenal lainnya yang berlaku.
      2. Rekening tujuan dalam konteks penarikan dana dari Dompet Rupiah harus sesuai dengan nama Pelanggan Emas Digital yang tercatat.
      3. SAKUMAS akan mengirimkan dana sesuai dengan instruksi penarikan dalam waktu paling lama 2 x Hari Kerja.
      4. Pelanggan Emas Digital dengan ini menyatakan setuju untuk mematuhi batas penarikan baik terhadap Emas Digital maupun Rupiah yang berlaku terhadap Akun Pelanggan Emas Digital, dan SAKUMAS yang dalam hal ini menerapkan prinsip Anti Money Laundering (AML) sesuai dengan regulasi Pemerintah Republik Indonesia diberi kuasa serta hak untuk tidak melakukan proses terhadap transaksi yang telah melebihi batas penarikan harian yaitu sebesar yang ditentukan oleh SAKUMAS.
      5. Batas penarikan direset ulang atau kembali pada angka 0 (nol) setiap pukul 00.00 Waktu Indonesia Barat (WIB).
      6. Pelanggan Emas Digital dapat mengajukan peningkatan batas penarikan dengan mengajukan permohonan melalui email kepada info@sakumas.com dengan Subject: “Peningkatan Batas Penarikan”.
      7. Batas Penarikan Rupiah dan Transaksi Emas Digital yang diatur secara standard adalah sebagai berikut:
        • a. Batas Penarikan Rupiah : Rp 100.000.000 / hari
          b. Batas Transaksi Emas Digital : 25 gram / hari

      8. Setiap penarikan dana dari Dompet Rupiah dikenakan biaya admin sebesar Rp 25.000 / penarikan. Besaran biaya penarikan ini dapat berubah sewaktu-waktu.
    4. Penarikan Emas Fisik dan Biaya-Biaya Terkait
      1. Emas Digital yang tersimpan dapat ditarik secara fisik menjadi Emas Fisik dalam bentuk Logam Mulia (“LM”).
      2. Permintaan pencetakan dan pengambilan Emas Fisik sebagaimana dimaksud pada 2.4.1. paling sedikit memuat:
        • a. satuan gram Emas;
          b. tanggal pengiriman;
          c. lokasi penyerahan Emas, dalam hal Emas diambil sendiri oleh Pelanggan Emas Digital di lokasi penyerahan Emas;
          d. identitas penerima; dan
          e. identitas jasa pengiriman dan asuransi pengiriman, dalam hal Emas dikirim ke alamat yang didaftarkan oleh Pelanggan Emas Digital.

      3. Permintaan pencetakan dan pengambilan Emas hanya dapat diproses apabila identitas penerima sebagaimana dimaksud dalam 2.4.2.d sama dengan identitas yang tercatat menjadi Pelanggan Emas Digital.
      4. LM yang disediakan adalah LM dengan kadar kemurnian minimal 99,9% dalam pecahan: 1 gram, 5 gram, dan 10 gram.
      5. Penarikan LM dengan pecahan di atas 10 gram dapat dilakukan dengan permintaan terpisah melalui email di info@sakumas.com. Serah terima LM dengan pecahan di atas 10 gram dilakukan secara tatap muka.
      6. Biaya cetak LM dihitung dengan menggunakan nilai tukar dalam gramasi emas dan dibayarkan menggunakan saldo Emas Digital.
      7. Biaya cetak LM adalah sebagai berikut:

      8. Pengiriman LM dilakukan menggunakan kurir pihak ketiga yang berasuransi. Besaran asuransi adalah 0,2% dari nominal LM yang dikirim dan dibebankan kepada Pelanggan Emas Digital dalam nominal gram Emas Digital
      9. Ongkos Kirim akan terhitung secara otomatis berdasarkan alamat yang tercantum dalam identitas Pelanggan Emas Digital.
      10. Pelanggan Emas Digital wajib memastikan bahwa alamat tercantum adalah benar. SAKUMAS tidak bertanggungjawab atas kesalahan pengiriman yang disebabkan oleh kesalahan penulisan alamat Pelanggan Emas Digital.
      11. Sesuai dengan PMK No 34/PMK.10/2017, setiap pembelian emas batangan di kenakan PPH 22 sebesar 0,45% untuk pemegang NPWP atau 0,9% untuk non NPWP. Jumlah besaran pajak akan disesuaikan berdasarkan ketersediaan data NPWP Pelanggan Emas Digital dan dibebankan kepada Pelanggan Emas Digital dalam nominal gram Emas Digital.
      12. Besaran biaya cetak, ongkos kirim, ongkos asuransi, dapat berubah sewaktu-waktu tergantung dari pihak ketiga dengan pemberitahuan terlebih dahulu.
    5. Penutupan Rekening
      1. Untuk menutup rekening, Pelanggan Emas Digital dapat melakukan penarikan seluruh Dompet Rupiah. Rekening tanpa aktivitas akan otomatis dinon-aktifkan dalam jangka waktu 1 tahun.
      2. Pelanggan Emas Digital juga dapat melakukan permohonan penutupan rekening dengan melakukan permohonan tertulis melalui email di info@sakumas.com
    6. FORMULA PERHITUNGAN TRANSAKSI

        Untuk kepentingan ilustrasi perhitungan transaksi Emas Digital maka diasumsikan Harga Emas Digital adalah sebagai berikut:

          a. Harga Beli Emas Digital : Rp 840.000 / gram
          b. Harga Jual Emas Digital : Rp 800.000 / gram

      1. Membeli Emas Digital
        1. Pembelian Emas Digital dapat dilakukan menggunakan Dompet Rupiah atau pembelian langsung menggunakan jasa payment aggregator.
        2. Pembelian Emas Digital melalui Dompet Rupiah tidak dikenakan biaya apapun. Pelanggan Emas Digital dapat melihat jumlah Emas Digital yang akan diperoleh sebelum mengkonfirmasi perintah pembelian Emas Digital.
        3. Pelanggan Emas Digital juga dapat melihat Harga Beli Emas Digital secara historis di dalam menu mutasi.
        4. Rumus perhitungan pembelian Emas Digital dengan menggunakan Dompet Rupiah adalah sebagai berikut:

        6. Contoh ilustrasi: Seorang Pelanggan Emas Digital memutuskan untuk membeli Emas Digital dengan menggunakan Dompet Rupiah sebesar Rp 1.000.000. Gram Emas Digital yang didapat adalah:

        8. Pembelian Emas Digital melalui jasa Payment Aggregator akan dikenakan convenient fee sesuai dengan kebijakan pihak ketiga.
        9. Pelanggan Emas Digital dapat melihat dan meninjau convenient fee sebelum mengkonfirmasi perintah pembelian Emas Digital.
        10. Rumus perhitungan pembelian Emas Digital dengan menggunakan Payment Aggregator adalah sebagai berikut:

        12. Contoh ilustrasi: Seorang Pelanggan Emas Digital memutuskan untuk membeli Emas Digital dengan menggunakan jasa payment aggregator sebesar Rp 1.000.000 dengan convenient fee Rp 6.500. Gram Emas Digital yang didapat adalah:

      2. Menjual Emas Digital
        1. Pelanggan Emas Digital dapat menjual Emas Digital kapanpun.
        2. Penjualan Emas Digital melalui tidak dikenakan biaya apapun. Pelanggan Emas Digital dapat melihat jumlah Rupiah yang akan diperoleh sebelum mengkonfirmasi perintah penjualan Emas Digital.
        3. Semua dana hasil penjualan Emas Digital akan otomatis tersimpan di dalam Dompet Rupiah Pelanggan Emas Digital.
        4. Pelanggan Emas Digital juga dapat melihat Harga Jual Emas Digital secara historis di dalam menu mutasi.
        5. Rumus perhitungan penjualan Emas Digital adalah sebagai berikut:

        7. Contoh ilustrasi: Seorang Pelanggan Emas Digital memutuskan untuk menjual Emas Digital sebesar 1 gram. Jumlah Rupiah yang didapat adalah:

      3. Menarik Emas Fisik
        1. Pelanggan Emas Digital dapat menukarkan Emas Digital menjadi Emas Fisik.
        2. Detail peraturan penarikan tercantum di poin 2.3.
        3. Semua biaya penarikan Emas Fisik akan dibayarkan dengan menggunakan Emas Digital
        4. Contoh ilustrasi: Seorang Pelanggan Emas Digital yang sudah terverifikasi NPWP memutuskan untuk menarik Emas Digital dalam bentuk Logam Mulia pecahan 10 gram. Jumlah Emas Digital yang dibutuhkan adalah:
            • Jumlah gram LM = 10 gram
              Nilai Tukar LM = 1,07 : 1
              Jumlah LM (Emas Digital) = 10,7 gram = Rp 8.560.000
              Pajak (NPWP – 0,45%) = Rp 38.520
              Asuransi (0,2%) = Rp 17.197
              Ongkos Kirim = Rp 15.000
              Total (Rupiah) = Rp 8.630.717
              Total (Gram Emas Digital) = 10,789 gram

      4. Perhitungan Untung / Rugi
        1. Aset Pelanggan Emas Digital terbagi menjadi Dompet Rupiah dan Dompet Emas.
        2. Perhitungan untung rugi dapat dilakukan dengan perhitungan sebagai berikut:

          Total Aset Akhir merupakan nilai aset Pelanggan Emas Digital yang dimiliki dalam bentuk Rupiah, Emas Digital, maupun Emas Fisik.

          Total Aset Awal merupakan nilai aset Pelanggan Emas Digital yang dimiliki di awal mula transaksi.

    7. KETENTUAN PELAKSANAAN TRANSAKSI
      1. Setiap transaksi pada Pedagang Fisik Emas Digital akan dicatatkan dan diselesaikan secara langsung pada waktu yang sama saat terjadinya transaksi ke PT Kliring Berjangka Indonesia.
      2. Pedagang Fisik Emas Digital akan melaporkan harga penyelesaian pada setiap akhir hari perdagangan ke PT Bursa Berjangka Jakarta.
      3. Transaksi Beli:
        • a. Dapat dilakukan jika mempunyai saldo dana yang mencukupi.
          b. Memilih volume jumlah gramasi.
          c. Pelanggan Emas Digital dapat memilih untuk mengisi gram atau memilih nominal dalam bentuk Rupiah

      4. Transaksi Jual:
        • a. Dapat dilakukan jika mempunya saldo yang mencukupi
          b. Mengisi volume jumlah gramasi
          c. Pelanggan Emas Digital dapat memilih untuk mengisi gram atau memilih nominal dalam bentuk Rupiah

      5. Maksimal – Minimal Transaksi
        1. Minimal transaksi Emas Digital adalah 0,01 gram
        2. Maksimal transaksi Emas Digital untuk semua Pelanggan Emas Digital adalah 25 gram / hari.
        3. Pelanggan Emas Digital dapat mengajukan peningkatan batas penarikan dengan mengajukan permohonan melalui email kepada info@sakumas.com dengan Subject: “Peningkatan Batas Transaksi”.
      6. Spread
        1. Spread untuk semua Harga Beli dan Harga Jual Emas Digital yang diberikan kepada semua Pelanggan Emas Digital dalam kondisi normal adalah 5%.
        2. Ketika pasar tidak dapat diperkirakan kondisinya/ keadaan “hectic” (pasar dalam kondisi tidak normal) maka spread untuk Harga Beli dan Harga Jual diberikan berdasarkan kondisi pergerakan dari harga yang diberikan oleh data provider.
      7. Pembatalan Transaksi
        1. SAKUMAS berhak untuk melakukan penundaan dan/atau pembatalan transaksi berdasarkan pertimbangan, dan dugaan bahwa terjadi kesalahan harga, kegiatan penipuan dan/atau aksi kejahatan telah dan/atau akan dilakukan.
        2. Pelanggan Emas Digital setuju dan mengakui bahwa sepanjang diperbolehkan oleh ketentuan Hukum yang berlaku, SAKUMAS berhak menolak untuk memproses segala transaksi.
        3. SAKUMAS berwenang untuk melakukan pemantauan atas Akun Pelanggan Emas Digital dalam rangka pencegahan kejahatan keuangan.
        4. Pelanggan Emas Digital mengerti, memahami dan setuju bahwa terhadap setiap transaksi yang telah dilakukan melalui SAKUMAS bersifat final dan tidak dapat dilakukan pembatalan oleh Pelanggan Emas Digital.
        5. SAKUMAS tidak akan bertanggung jawab untuk setiap kerugian (baik secara langsung dan termasuk namun tidak terbatas pada kehilangan keuntungan atau bunga) atau kerugian yang diderita oleh pihak manapun yang timbul dari segala penundaan atau kelalaian dari SAKUMAS untuk memproses segala perintah pembayaran tersebut atau informasi atau komunikasi lainnya atau untuk melaksanakan segala kewajiban lainnya, yang disebabkan secara keseluruhan atau sebagian oleh segala tindakan yang diambil berdasarkan ketentuan Penolakan dan Penundaan Transaksi ini.
      8. Kesalahan Harga

        Dalam keadaan normal, harga dianggap salah apabila Harga Beli dan Harga Jual Emas Digital terpaut terlalu jauh dari referensi harga yang tersedia: spot emas, atau Bursa Berjangka.

    8. WAKTU PERDAGANGAN

        Dalam keadaan normal, Pelanggan Emas Digital dapat melakukan transaksi setiap saat (24 jam x 7 hari).
        Hari Perdagangan : Senin – Minggu
        Jam Perdagangan : 00:00 – 24:00

    9. SPESIFIKASI EMAS

        Emas Digital, Emas Fisik, dan Emas Logam Mulia yang dimaksud di dalam konteks perdagangan Emas Digital memiliki spesifikasi teknis paling sedikit sebagai berikut:
        a. Kadar Emas paling rendah 99,9%
        b. Memiliki sertifikat yang mencakup logo, berat, dan kode seri emas. Kode seri emas untuk pecahan Logam Mulia di bawah 10 gram, mungkin tidak tercantum sesuai dengan ketentuan manufaktur Emas Logam Mulia.
        c. Satuan Emas dalam berat yakni: 1 gram, 2 gram, 5 gram, 10 gram, 25 gram, 50 gram, 100 gram, 250 gram, dan 1.000 gram.

    10. KETENTUAN PENYERAHAN
      1. Penyerahan Emas Fisik dilakukan menggunakan jasa kurir pihak ketiga yang ditunjuk oleh Pedagang Fisik Emas Digital dengan menggunakan layanan pengiriman berasuransi.
      2. Setelah Pelanggan Emas Digital melakukan penarikan Emas Fisik, Pelanggan Emas Digital dapat akan mendapatkan resi pelacakan.
      3. Ketika menerima paket, Pelanggan Emas Digital wajib memeriksa keadaan paket. Pelanggan Emas Digital berhak untuk menolak paket jika kondisi rusak / robek.
      4. Pelanggan Emas Digital wajib melakukan perekaman dalam proses pembukaan (unboxing) paket demi menjaga asuransi dari pihak kurir.
    11. MEKANISME PENYELESAIAN PERSELISIHAN
      1. Dalam hal terjadi perselisihan antara para pihak dalam penyelenggaraan Pasar Fisik Emas Digital, terlebih dahulu dilakukan penyelesaian dengan cara musyawarah untuk mencapai mufakat antara para pihak dalam batas waktu sebagaimana diatur dalam perjanjian antar para pihak;
      2. Dalam hal tidak tercapai mufakat sebagaimana dimaksud pada 8.1., para pihak dalam Pasar Fisik Emas Digital yang berselisih dapat menyelesaikan melalui sarana penyelesaian perselisihan yang disediakan oleh Bursa Berjangka dalam batas waktu sebagaimana diatur dalam perjanjian antar para pihak dan/atau peraturan dan tata tertib Bursa Berjangka;
      3. Dalam hal tidak tercapai mufakat sebagaimana dimaksud pada 8.2., para pihak dalam Pasar Fisik Emas Digital yang berselisih dapat menyelesaikan melalui Badan Arbitrase Perdagangan Berjangka Komoditi (BAKTI) atau Pengadilan Negeri sesuai pilihan forum penyelesaian perselisihan yang diatur dalam perjanjian antar para pihak.

    Welcome to Sakumas platform directly operated by PT. Sehati Indonesia Sejahtera. Sakumas is committed to be responsible based on laws and regulations on privacy applicable in Indonesia (“Privacy Law”) and is fully committed to respect privacy rights and issues of all Members/Verified Members registered in our platform.

    The following Privacy Policy provides an explanation of how Sakumas, along with terms of use of Sakumas platform as set out in “Terms & Condition” and other Information stated in Sakumas website, stipulates the basis in collecting, storing, using, processing, controlling, transferring, disclosing, and protecting Personal information of Member /Verified Member which Sakumas has obtained and collected from Member/ Verified Member consisting of personal data of Member/Verified Member, which Member/Verified Member uses while performing registration, accessing, and using services in Sakumas platform.

    It is important for Member/Verified Member to be aware of and understand this Privacy Policy along with other applicable information, which will be used as the basis of management of personal data of Member/Verified Member. This Privacy Policy (“Privacy Policy”) is designed to help Member/ Verified Member to understand how Sakumas collects, uses, discloses, and/or processes personal data a Member/Verified Member entrusts to Sakumas and/or which Sakumas has about Member/Verified Member, whether at present or in the future, and to help Member/Verified Member to make the right decision prior submitting personal data of Member/Verified Member to Sakumas. By continuing to access and always using Sakumas Services, the Member/Verified Member is hereby deemed to agree with all Privacy Policies stated in Sakumas platform along with the amendments thereto.

    IN THE EVENT THAT MEMBER/VERIFIED MEMBER DOES NOT PERMIT THE PROCESSING OF PERSONAL DATA OF MEMBER/VERIFIED MEMBER AS EXPLAINED IN THIS PRIVACY POLICY, WE DO NOT ADVISE TO USE Sakumas SERVICES OR TO ACCESS Sakumas PLATFORM. In the event that Sakumas makes any amendment to Sakumas Privacy Policy, Sakumas will post such amendment or the Privacy Policy which has been amended on Sakumas Platform. Sakumas has full rights to amend this Privacy Policy at any time without requiring approval from Member/Verified Member but by referring to the applicable laws and regulations.

    This Privacy Policy includes matters as follows:

      1. Personal Information is any form of Information whether or not recorded in material form, and based on such information, the identity of a person can be directly seen or identified and reasonably known and can be directly ensured by an organization or entity which collects such information, or when combined with other information, which can directly or indirectly identify a person, and which can or may be accessed by an authorized Party in case any issue arises.
      2. While Member/Verified Member is using Sakumas Services, Sakumas may collect Personal Information of Member/Verified Member, including but not limited to the following:
        1. Identity data, such as name, gender, profile picture, and date of birth;
        2. Contact data, such as delivery, electronic mail address, and phone number;
        3. Account data, such as bank account and payment details;
        4. Transaction data, such as details of order or purchase of crypto asset or history of transactions performed by Member/Verified Member while using Sakumas platform;
        5. Technical data, such as Internet Protocol (IP) address, login data, type and version of browser, settings of time and location cone, type and version of browser plug-in, operating system and platform, identity of device and device-related matters while using Sakumas platform;
        6. Profile data, such as username and password, purchase, order or preference intention, and response to reply and survey;
        7. Usage data, such as information on how Member/Verified Member uses Sakumas platform, products, and Services;
        8. Location data, namely the method used by Member/Verified Member while taking and sharing location with Sakumas in the form of picture or video and uploading them to Sakumas platform;
        9. Biometric data, namely sound file when Member/Verified Member uses the feature of face or other body part and sound or others which become the feature of device by uploading it to the platform;
        10. Marketing and correspondence data, namely matters related to preferences of Member/Verified Member in receiving marketing materials from Sakumas and third parties and communication preferences of Member/Verified Member.
      3. Member/Verified Member agrees not to submit any information which is inaccurate or misleading, and Member/Verified Member agrees to inform about the inaccuracy or change of such information. Sakumas has the right of discretion to require further documentation to perform verification of information submitted by Member/Verified Member.
    2. Use of Data by the platform and ability of Sakumas to receive personal data of Member/Verified Member in the situations as follows:
      1. When Member/Verified Member makes account in Sakumas platform or updates Sakumas account, including therein username, e-mail address, phone number, password, address, etc.;
      2. When Member/Verified Member uses a feature or function available on Sakumas platform;
      3. When Member/Verified Member registers for a service of Sakumas platform or purchases a crypto asset product available on Sakumas platform;
      4. When Member/Verified Member records and uploads a user-generated content to Sakumas platform;
      5. When Member/Verified Member uses the chatting function on Sakumas platform;
      6. When Member/Verified Member participates in a competition, promotion, or survey;
      7. When Member/Verified Member participates in an activity or campaign on Sakumas platform;
      8. When Member/Verified Member logs into their account or interacts with Sakumas through external service or application;
      9. When Member/Verified Member interacts with us off-line, including when Member/Verified Member interacts with outsourced employees of Sakumas off-line.
    3. Use of Data

      Sakumas may use all or some data obtained and collected from Member/ Verified Member as referred to in the previous section for matters as follows:

      1. To identifying and register Member/Verified Member as user and to administer, verify, deactivate, or manage account of Member/ Verified Member;
      2. To facilitate or enable any verification which we consider necessary before Sakumas provides services to Member/Verified Member or before we register Member/Verified Member as user, including the Know Your Customer process;
      3. To enable Sakumas to provide, process, and facilitate, orders and payment transactions;
      4. To facilitate Member/Verified Member Service in implementing instruction of Member/Verified Member, dealing with or responding to any question raised by (or supposedly raised by) Member/Verified Member and/or on behalf of Member/Verified Member.
      5. To communicate with Member/Verified Member and send information in connection with the use of platform, including but not limited to information about any update as well as support which may be required from time to time to ensure continuity of Sakumas Services;
      6. To inform Member/Verified Member about any update to Sakumas platform or update to services provided;
      7. To monitor and analyze activity, behavior, and demographic data, including habits and responsiveness of Sakumas to various services available on the platform;
      8. To send Member/Verified Member direct or targeted marketing communication, advertising, promotion, survey, and special offer or promotion;
      9. To use information obtained from Member/Verified Member for the purpose of research, analysis, development, and testing of product in order to improve safety and security of services on the Website, as well as for developing new feature and product;
      10. To perform monitoring or investigation of suspicious transactions or transactions indicated of containing the element of fraud or violation against the Terms and Conditions or the applicable legal provisions, as well as to take the necessary actions as follow-up of the result of monitoring or investigation of such transactions;
      11. In certain situations, Sakumas may need to use or disclose User's data for the purpose of law enforcement or for the fulfillment of requirements of the applicable laws and regulations, including in the event of any dispute or legal proceeding between Member/ Verified Member and Sakumas;
      12. Any other purpose which Sakumas will inform Member/Verified Member when obtaining approval from Member/Verified Member is collectively referred to as (“Purpose”);
      13. Due to Purpose, Sakumas will/may collect, use, disclose, or process personal data of Member/Verified Member depending on the situation encountered, and it is possible that such purpose is not state above. However, Sakumas will inform Member/Verified Member about such other purpose of that kind when obtaining approval from Member/Verified Member, except for data processing which applies without approval from Member/Verified Member permitted by the Privacy Law.
    4. Disclosure of Personal Data of Member/Verified Member

      Sakumas guarantees that there is no sale, leakage, transfer, distribution, or lending of personal data of Member/Verified Member to other party, without permission from Member/Verified Member, except in the event of occurrence of the following matters or events:

      1. When there is requirement for disclosure of data of Member/ Verified Member to other party assisting Sakumas in providing services on Sakumas platform and processing any form of activities of Member/Verified Member on Sakumas platform, including but not limited to transaction process, payment verification, etc.;
      2. Sakumas may provide and make available relevant data or information to Sakumas business partner in accordance with rules of approval from Member/Verified Member to use business partner's services, which are included in the application, website, or other platform which integrates API or its services, or business partner with whom Sakumas has cooperated to deliver forms of promotional services, contest, or other dedicated matters;
      3. Other matters required by Sakumas such as banking, payment, and other services with Member/Verified Member, in this case including settlement of obstacles and other matters;
      4. Sakumas may provide relevant information to vendor, consultant, marketing partner, research firm, or similar service providers;
      5. Sakumas may share information of Member/Verified Member to its subsidiaries and affiliates to help in maximizing or providing services as well as data processing for and on behalf of Sakumas;
      6. Sakumas discloses data of Member/Verified Member in an effort of complying with and fulfilling legal obligations and/or based on valid request from Similar Law Enforcement Agencies and Apparatus.
    5. Storage and Deletion of Information
      1. Personal Information of Member/Verified Member will only be stored as long as necessary for fulfilling the purpose of its collection, or as long as such storage is required or allowed by the applicable laws and regulations. Sakumas will stop storing Personal Information, or delete the purpose of linking such Personal Information to you as an individual, as soon as it is considered that the purpose of collection of such Personal Information does not require storing Personal Information anymore and the storage is not necessary anymore for business or legal purposes.
      2. Personal Information of Member/Verified Member collected by Sakumas may be stored, transferred, or processed by a third party service provider. Sakumas will take reasonable effort to ensure that all of such third party service providers provide a level of protection equivalent to the commitment of Sakumas based on this Privacy Policy.
      3. Personal Information of Member/Verified Member may also be stored or processed outside the country of the Member/Verified Member by a party working for Sakumas in other country, or by third party service provider, vendor, supplier, partner, contractor, or affiliate of Sakumas. In this case, Sakumas will ensure that such Personal Information continues to be a subject of level of protection equivalent to those required in the law of the country (and, in any case whatsoever, in line with our commitment in this Privacy Policy).
      4. Sakumas will store and process Information as long as the account of Member/Verified Member is active.
    6. Cookies
      1. Cookies are small data storage in a computer or other device when Member/Verified Member browses and/or visits Sakumas.
      2. Cookies are identifier transferred to computer or mobile device of Member/Verified Member which enables us to identify the computer or device of Member/Verified Member and informs Sakumas about how and when Services or Platform is used or visited, by how many persons, and to trace activities on the Sakumas Platform. Sakumas may link information cookies to personal data. Cookies are also linked to information on transactions of Member/Verified Member and Cookies are also used to deliver specific content in accordance with the interests of Member/Verified Member and to monitor the use of Sakumas Services.
      3. Member/Verified Member will automatically receive Cookies when the Computer or Device of Member/Verified Member uses or browses Sakumas platform. However, Member/Verified Member may choose to modify or choose to refuse the Use of Cookies through web or browser setting preferences in the device or computer of Member/Verified Member.
      4. Sakumas uses Google Analytics (“Feature”), in which data obtained from the use of such Feature include IP address of Member/Verified Member, type of device of Member/Verified Member, etc. (“Data”). Such data are used by Sakumas for the development of platform and Content of Sakumas as well as advertisement. Member/Verified Member may choose to be inaccessible by Feature by means of downloading Google Analytics Opt-Out Add-on on web browser of Member/Verified Member.
      5. Sakumas may use and provide information on data of Member/Verified Member Sakumas obtained from the Use of Cookies by Member/Verified Member to a third party, such as location data, advertising identifier, or e-mail address used for advertisement, including but not limited to for promotional and advertisement purposes in which such data cannot personally identified.
      6. The use of Cookies can be controlled by Member/Verified Member through setting preferences of web browser used by Member/Verified Member, namely by making modification or choosing to refuse the Use of Cookies. However, by making such setting, performance of service during access to Sakumas platform may be affected, such as certain functions and pages on Sakumas Website unable to perform optimally for the provision of services to Member/Verified Member.
    7. Personal Data Protection of Member/Verified Member
      1. Sakumas applies various safety measures and strives to ensure Personal Data of Member/Verified Member in Sakumas system. Personal data of Member/Verified Member are kept behind a secure network and only accessible by a small number of employees having special access right to the system. Nevertheless, the absence of absolute guarantee or security is unavoidable.
      2. Sakumas will keep personal data in accordance with the Privacy Law and/or other applicable laws. Namely, Sakumas will destroy or anonymize personal data of Member/Verified Member when Sakumas reasonable deems that (i) the purpose of personal data which have been collected is not functioned anymore by the storage of such personal data; (ii) the storage is not necessary anymore for any legal or commercial purposes whatsoever; and (iii) there is no instruction letter legitimating further retrieval of personal data. In the event that a Member/Verified Member stops using Sakumas Platform, or the license of a Member/Verified Member to use Platform and/or Services is terminated or revoked, Sakumas may continue to keep, use, and/or disclose personal data of Member/Verified Member in accordance with the Privacy Policy and obligations of Sakumas under the Privacy Law. Subject to the applicable law, Sakumas may securely dispose personal data of Member/Verified Member without any prior notification to Member/Verified Member.
    8. Information on children

      Services are not intended for children aged less than 17 years. Sakumas does not intentionally collect or store personal data or any non-personal information from any person aged less than 17 years and any part of Platform or other Services of Sakumas is not intended for children aged less than 17 years. As parent or legal guardian, please do not give permission to children under your care to submit personal data to Sakumas. In the event that personal data of children aged less than 17 years under your care are opened to Sakumas, you hereby consent to the processing of personal data of the child and accept and agree to be bound to this Privacy Policy on behalf of such child. Sakumas will close any account used exclusively by such children and will eliminate and/or delete any personal data Sakumas believes to be sent without consent of parent or legal guardian by a child aged less than 17 years.

    9. Disclaimer of Security and Third Party Website
      1. Sakumas DOES NOT GUARANTEE SECURITY OF PERSONAL DATA AND/OR OTHER INFORMATION THE MEMBER/VERIFIED MEMBER SUBMITS ON A THIRD PARTY WEBSITE. Sakumas has indeed implemented a variety of security measures to maintain the safety of personal data of Member/ Verified Member with or under the control of Sakumas. Personal data of Member/Verified Member are kept behind a secure network and only accessible by a limited number of persons having special access right to the system, who are obligated to keep the confidentiality of such personal data. In the event that the Member/Verified Member places an order or accesses personal data, Sakumas offers the use of secure server. All personal data or sensitive information submitted by Member/Verified Member are encrypted into our database and can only be accessed as stated above;
      2. In an effort of providing Member/Verified Member with increasing value, Sakumas may choose various third party websites to be linked to, and to frame them in the Platform. Sakumas may also participate in co-branding and other relationship to offer e-commerce as well as other services and features to Sakumas visitors. All of these linked websites have separate and independent privacy policy and security settings. Even if a third party is affiliated to Sakumas, Sakumas has no control over these linked websites, since each of them has privacy and data collection practices separated from Sakumas. It is possible that data collected by Sakumas co-branding partner or third party website (even if it is offered on or through Sakumas Platform) are not received by Sakumas;
      3. Therefore, Sakumas is not responsible or accountable for content, security settings (or the absence of security settings), and activities of these linked websites. These linked websites are only for the convenience of Member/Verified Member, and therefore Member/Verified Member accesses them at the Member/Verified Member's own risk. Nevertheless, Sakumas strives to protect the integrity of Sakumas Platform and links placed on each website, and therefore, Sakumas welcomes any feedback on these linked websites (including, but not limited to, in the event that certain link is not functioning).
    10. Update of Privacy Policy

      Sakumas may update this Privacy Policy at any time. Sakumas hereby advises Member/Verified Member to read carefully and always recheck every page of this privacy policy from time to time to find out about any changes which have been made to this Privacy Policy.
